TERMS OF DELIVERY

Orders are processed by the end of the next business day. You will also receive an email to confirm the order when finalizing it.

A representative of "OptiArt" Ltd. will contact you by phone ONLY if you need clarification about the order.

Delivery

Deliveries are made to all continents and countries according to the supplier's tariff.

Delivery is calculated and noted when adding a product to the cart.

The consumer has the right, without paying compensation or penalty and without stating a reason, to withdraw from the contract within 14 working days.

The consumer has the right to return the purchased product within 14 working days, and the delivery is at his expense.

The 14-day period starts from the date of:

• concluding the contract - for a service contract;

• acceptance of the goods by the consumer or by a third party other than the carrier.

I. SUBJECT

1. The General Terms and Conditions govern the relations between OptiArt EOOD, Bulgaria, Sofia-city district, residential complex Polygon, bl. 43, ent. A, fl. 2, office 6, UIC 206485459, represented by Svetlozar Ivanov, manager, hereinafter referred to as SUPPLIER, and clients, hereinafter referred to as USERS on www.artmasters.online, hereinafter referred to as artmasters.online

2 According to the Electronic Commerce Act and the Consumer Protection Act, we provide the following information:

4. The Provider delivers the products ordered by the User through the order form on artmasters.online. The Provider guarantees the rights of the Users by virtue of the Bulgarian legislation, within the framework of the accepted in practice, consumer or commercial law, criteria and conditions.

5 (1) Users, accepting the general conditions of the Provider, enter into a contract of sale of products offered in artmasters.online, through the interface of the Provider, available on its website www.artmasters.online. The contract is concluded in Bulgarian or English and is stored in the database of the Provider.

(2) Pursuant to this contract, the Provider is obliged to deliver to the User the products ordered through the interface of the Provider. Users can correct errors in spelling, contact information, etc. no later than submitting the statement for concluding the contract with the Provider.

(3) The users pay to the Provider remuneration for the delivered products according to the general conditions, determined and published in artmasters.online. The remuneration is equivalent to the price mentioned by the Provider on the internet address artmasters.online.

(4) The Provider delivers the products ordered by the User within the agreed time and under the conditions mentioned in the General Terms of Use of artmasters.online.

6 (1) All statements arising between the User and the Provider, in connection with the conclusion of this contract, may be realized through electronic statements within the meaning of the Electronic Document and Electronic Signature Act and Art. 11 of the Electronic Commerce Act.

(2) The electronic statements made by the Users of artmasters.online shall be made by the persons indicated in the data entered in the order form.

IV. USE OF artmasters.online

7 (1) The user concludes a contract of sale, filling in name, email, phone and delivery address through the order form of artmasters.online.

(2) After filling in the data and accepting the general conditions by ticking in the special field "I accept the general conditions", the User declares that he is familiar with the general conditions, agrees with them and undertakes to comply with them.

(3) The Provider confirms the accepted order of the User by sending an e-mail to the e-mail address specified by the User.

(4) The user is obliged to fill in up-to-date and correct data in the order form.

V. CONTENT OF THE CONTRACT

The procedure for concluding a contract of sale by the User is performed as follows:

1. The user chooses to purchase one or more products from the artmasters.online website.

2. Enter in the order form the necessary data to make the delivery.

3. Indicates in the special field that it accepts the General Terms of Use of artmasters.online.

4. By clicking the "Order" button, the User finalizes the order and sends it to the Provider for confirmation.

5. Order confirmation.

9 (1) For each product ordered through the order form of artmasters.online, separate contracts of sale are concluded.

(2) The supplier may deliver the products ordered with different contracts of sale, together and simultaneously.

(3) The exercise of rights for delivered goods shall affect only the goods for which the contract has been concluded. They have no effect on concluded contracts for other goods. If the User can be determined as a consumer within the meaning of the Consumer Protection Act, the exercise of the right of withdrawal from the contract of sale of a particular product does not affect the contracts of sale of other goods delivered to the User.

10 When the User decides to exercise his rights under the contract of sale, he is obliged to specify the contract and the product for which he exercises his rights.

11 The user can pay for all orders and sales contracts at once, when making the order or when delivering it.

VI. SPECIAL CLAUSES AFFECTING PERSONS AS CONSUMERS WITHIN THE MEANING OF THE CONSUMER PROTECTION ACT

12 The provisions of this section of the General Terms and Conditions apply only to Users who, according to the data specified in the conclusion of the contract of sale, may be classified as consumers within the meaning of the Consumer Protection Act, the Electronic Commerce Act and / or Directive 97/7 / EC of the European Parliament and of the Council of 20 May 1997 on the protection of consumers in respect of distance contracts.

13 (1) The products offered by the Provider are presented with their main characteristics on the site artmasters.online

(2) The price of the products with the included taxes and fees shall be written in the profile of each product when ordering, as well as in the confirmation email to the User.

(3) The value of transport costs, which are not included in the price of the product, is determined by the Supplier and presented to the Users when choosing the product for concluding a contract of sale on the website artmasters.online

(4) The methods of payment, delivery and performance of the contract are determined by these General Terms and Conditions, submitted through the website of the Provider of artmasters.online

(5) The information under Article 13 is visible to the User when ordering the product, before concluding the contract of sale.

14 The User pays to the Provider the price for delivery of the products before the moment of delivery.

15 (1) The consumer has the right, without paying compensation or penalty and without stating a reason, to withdraw from the contract within 7 working days from the date of receipt of the product.

(2) The right of refusal under para 1 shall not be applied in the following cases:

- for delivery of goods and provision of services, the price of which depends on the fluctuations of the financial markets, which the Provider is not able to control.

- for deliveries of goods made in accordance with the requirements of the User or by his order.

- for the supply of goods which, by their nature, cannot be returned or are subject to rapid deterioration or are in danger of deteriorating.

(3) When the provider has not fulfilled its obligations for providing information, determined in art. 54 of the Consumer Protection Act, the consumer has the right to withdraw from the contract within three months from the date of receipt of the goods. When the information under this paragraph is provided to the User within the withdrawal period, it shall run from the date of its provision.

(4) In case the User exercises his right of withdrawal under paragraph 1, the Provider is obliged to refund in full the amounts paid by the User no later than 30 calendar days from the date on which the User exercises his right of withdrawal from the contract. The costs paid for the return of the goods are deducted from the amount paid by the User under the contract, unless the User has returned the goods at his own expense and has notified the Supplier.

(5) The consumer shall be obliged to store the goods received from the supplier, their quality and safety during the term under para 1.

(6) The User may exercise his right to withdraw from the contract with the Provider by sending a written statement to the Provider at the address specified above.

17 (1) The term of delivery of the goods is determined for each goods separately in relation to the terms determined by the delivery company.

(2) In case the User and the Supplier have not set a delivery time, the delivery time of the products is 60 working days from the date following the sending of the User's order to the Provider through the order form on artmasters.online.

(3) If the Supplier cannot fulfill the contract due to the fact that he does not have the ordered goods, he is obliged to notify the Consumer and to refund the amounts paid by him within 30 working days from the date on which the Supplier should have fulfill its obligation under the contract.

(4) In the cases under par. 3, the Supplier has the right to deliver to the User goods of the same type, quality and price. The Provider notifies the User electronically of the change in the performance of the contract.

18 The supplier undertakes to comply with the provisions of the Bulgarian legislation on labeling, advertising and sale of food additives.

VII. PERFORMANCE OF THE AGREEMENT

19 (1) The supplier shall deliver the products within the term determined at the conclusion of the contract of sale.

(2) If for any reason the delivery is impossible, the Provider notifies the User electronically of the reasons for the impossibility of delivery and agrees on a new delivery date.

(3) If the term for delivery is not mentioned in the contract (para 1), the Supplier shall deliver the goods not later than 2 months.

20 (1) The User inspects the delivered product at the time of delivery and delivery by the courier or the representative of the Provider. If there is a reason for complaints, the User must immediately notify the Provider.

(2) If the User does not submit his requests for complaints to the Provider according to para. 1, the delivery of the products is considered approved and meets the requirements.

21 The rules and provisions of the Commercial Law shall apply to the cases not settled in this section.

VIII. PROTECTION OF PERSONAL DATA

22 (1) The Provider protects the personal data of the User according to the Personal Data Protection Act.

(2) In order to protect the personal data of the User, the Provider will send the personal data once to an e-mail address entered by the User during the order.

(3) The User may store data in the final communication device of the User, unless the latter expresses his disagreement.

(4) The User agrees that the Provider has the right to send to the User at any time electronic newsletters, offers for purchases of products, promotions, etc. by electronic means.

(5) The Provider has the right to collect, store and process data on the actions of the User during the use of the electronic store of the Provider.

23 (1) The Provider has the right to ask the User to identify himself at any time and to certify the data entered by the User in the online order form on artmasters.online.

IX. AMENDMENT AND ACCESS TO THE GENERAL TERMS

24 (1) The Provider reserves the right to change these General Terms and Conditions by notifying the users of artmasters.online.

(2) The Provider and the User agree that any amendment to these General Terms and Conditions will have an impact on the User under any of the following conditions:

- after notification by the Provider, if the User does not state within 14 days that he does not accept the amendments to the General Terms.

- after their publication on the website of the provider artmasters.online, if the User does not state within 14 days of their publication that he rejects them.

(3) The User agrees that all amendments and additions to these General Terms and Conditions will be sent to the e-mail entered by the User in the online order form of artmasters.online. The provider does not need to sign emails with an electronic signature.

25 These General Terms and Conditions are published at www.artmasters.online together with all additions and amendments thereto.

X. TERMINATION

26 The distance sales contract, as well as these General Terms and Conditions, are terminated under the following conditions:

- upon termination of the activity by the Provider, upon declaration of liquidation or bankruptcy of the Provider or the User.

- by mutual consent of both parties, expressed in writing.

- in the presence of objective circumstances for non-performance of the contract and the obligations arising from it, to one of the two parties to the contract.

- in case of sealing and / or seizure of the equipment by the state authorities

27 The Provider has the right, without prior notice and without compensation, to unilaterally terminate the contract if it finds that the User uses artmasters.online in violation of these Terms, the legislation of the Republic of Bulgaria, generally accepted social, moral and ethical norms, as well as in case of violation of the generally accepted rules in e-commerce.

XI. RESPONSIBILITY

28 The User undertakes to indemnify and release from liability the Provider in case of lawsuits and other claims of third parties (whether justified or not), for all damages and costs (including attorney's fees and court costs) arising from or in connection with c (1) failure to fulfill any of the obligations under this Agreement, (2) infringement of copyright, producer's broadcasting rights or other intellectual or industrial property rights, (3) unlawful transfer to others of the rights granted to the User for the term and under the terms of the contract and (4) falsely declaring the presence or absence of consumer quality within the meaning of the Consumer Protection Act.

29 The provider is not responsible in cases of force majeure, unforeseen events, problems with Internet access, technical or other objective reasons.

30 (1) The provider is not responsible for a breach in the security measures of the technical equipment of the site artmasters.online and for possible subsequent loss of information, access to information, inability to access information, etc.

(2) The Provider is not responsible in case of a contract of sale, access to information, loss or change in data, etc., by a person with a false identity, posing as the User.

XII. OTHER TERMS

31 (1) The User and the Provider protect their rights and legitimate interests, keep trade secrets, which are part of the implementation of this Sales Agreement.

(2) The correspondence between the two parties, conducted during and after the expiration of the contract, may not be in the public domain. Public domain means its publication in print and / or electronic media, internet forums, websites, blogs, etc.

32 If there is a special contract between the Provider and the User, which contradicts any of the clauses of this contract of sale, the clauses of the special contract are valid.

33 The invalidity of any of the clauses in the general conditions does not lead to the invalidity of the entire contract of sale.

34 For unsettled issues in this contract, the laws of the Republic of Bulgaria shall apply.

35 These General Terms and Conditions are valid for all users from 01.01.2022.
